1. 2. Any person interested in purchasing the property can do so by bidding online from their own computer at our website, via the internet. If you are unable to bid online, we will assist you in any way possible. Please be aware of the auction information posted for this sale.
3. All bids are in U.S. dollars only. All prospective bidders must have their financial arrangements made prior to bidding on any of our Real Estate Auctions. You will be required to have a letter from your bank or lender stating you do have the funds to move forward with the purchase of this property. This property sells with NO BUYER CONTINGENCIES. Please be certain that you understand this paragraph of terms.
4. An earnest money deposit of $ 5,000.00 will be required from the successful bidder(s) within 24 hours after the auction has concluded. The earnest money can be made by cash, personal check or bank transfer. Earnest money is irrevocable, so should buyer not close this transaction, earnest money will NOT be refunded for any reason.
5. At the conclusion of the auction, we will meet with the successful bidder in order to sign the Offer & Purchase Agreement, and collect the earnest money.
6. Seller shall furnish the required deed for the property.
7. Seller shall pay the South Dakota transfer tax.
8. All Real Estate taxes shall be prorated to closing,
9. Title Insurance shall be provided and paid for by the Seller.
10. Seller will not provide a location exhibit or survey, which shall be a Buyer Expense. 11. This transaction shall close at Pennington Title Co. in Rapid City, SD. 57701.
12. Possession to go to the Buyer at Closing. Closing to be on or before June 30th 2021.
13. A 6% Buyers Premium will be added to the final high winning bid to achieve the total contract price for this property.

• All items are sold as is, where is. No guarantees are expressed or implied. Once an item
• is announced as SOLD, bidder is responsible for it.
• Buyer shall be responsible at Buyers expense for the removal of all item(s) purchased from the auction site.
• It is the Buyers responsibility to inspect all items prior to bidding. All sales are FINAL.
• Auctioneer, Sellers, and Service Providers are NOT responsible for lost or insufficient internet or telephone service that may limit the buyer’s ability to participate in the auction of any item(s) in the auction.
• All purchases must be paid for in full and in US funds at the conclusion of the auction and prior to the removal of any item(s).
• Not responsible for errors or omissions in any listings, either online or in print.
• Buyer’s premiums may be in effect on some auctions and will be added to the final bid amount.
• Messner Auction Co. shall not be responsible in any manner for any type of damages, caused in whole or in part for packing, loading, or transporting of any items once they have been purchased by the Buyer.
• Decisions by the Auctioneer are final.
• All onsite auctions require a valid ID to register.
• Payments made by credit card will have a 5% processing fee added to the final price. Payments made by check must be local Rapid City area checks only. No out of state personal checks.
• All announcements made day of auction, or time of sale will take precedence over any and all other advertising or representations whether printed or verbal.
• Some items may be subject to a reserve or minimum price.
• Applicable sales tax will be collected.
• Buyer agrees upon registering for an auction, either onsite or online, they will be bound to all of its terms and conditions.
• If Buyer is the successful bidder, and fails to make payment when due, Buyer agrees to reimburse auctioneer or the owner of the item(s) for collections and court costs, including attorney fees, and agrees that interest shall accrue on the unpaid balance due at 21% annual percentage rate. Any legal disputes shall be settled in the appropriate South Dakota Court, pursuant to South Dakota Laws.
Any Titled Item sold , a Buyer will not receive a title for 14 business days unless Buyer pays in CASH, then title will be mailed in 5 days. Any Title issues of any kind shall be between the Buyer and the Seller once Title has been delivered or mailed by Auction Co.. Any errors or omissions on a Title shall be Buyer's to resolve, it shall not be the Auction Co..
